1. Who contracts with whom
These Terms of Use apply between you and Just Viral GmbH & Co. KG, Reinholdstraße 5, 21073 Hamburg, Germany (“we”), for the use of Sammelmomente at sammelmomente.de. They apply to hosts who create an event and – as far as use of the event camera is concerned – to guests who join one. Any differing terms of yours do not become part of the contract, even if we do not expressly object to them.
For the purchase of a paid package your contractual partner is not us but Digistore24 GmbH as the seller (see clause 4). These terms govern how you use Sammelmomente.
2. What Sammelmomente provides
Sammelmomente provides a private event camera with time-limited photo storage. The host creates an event and shares the secret access, usually as a QR code. Guests take photos in the browser on their own device; no guest account is created. The number of guests, photos per guest, storage period and additional features depend on the package booked; the current values are listed on the pricing overview.
Downloaded photos carry the “sammelmomente.de” wordmark, except in the package with custom branding. Photos are resized on upload to an edge length of at most 2560 pixels. Sammelmomente is a photo camera only; video is not supported.
Sammelmomente is intended for private celebrations. Use by companies, associations or other organisations – in particular any use in which we would process personal data on your behalf – is possible only after prior agreement with us, because that requires a data processing agreement.
3. Account, conclusion of contract and age
You need an email address for an account. Signing in works via a link sent by email or, optionally, via a Google account; there is no password. The contract for the free offering is concluded as soon as you expressly confirm these Terms of Use and your account is created.
You must have full legal capacity, i.e. be of age, in order to create an account and an event. Guests under 16 may take part in the event camera only with the consent of those with parental responsibility.
Keep your sign-in link and your event link secret. Anyone holding the event link can join the event – that is intended and cannot technically be limited to particular people.
4. Packages, prices and payment
The free package can be used without payment. Paid packages are paid for once per event. All prices are final prices in euros and include statutory VAT. There is no subscription and no automatic renewal.
Paid packages are sold by Digistore24 GmbH, St.-Godehard-Straße 32, 31139 Hildesheim, Germany, in its own name as a reseller. The purchase contract is therefore concluded between you and Digistore24; its general terms and conditions, consumer information and withdrawal policy apply and are shown to you during checkout. Digistore24 issues the invoice and handles payment, refunds and withdrawal. Your bank statement will show “Digistore24”.
A package is unlocked as soon as Digistore24 confirms the payment to us. Moving up to a larger package is charged at the full price of the new package; amounts already paid are not credited. A package applies to exactly one event and cannot be transferred to another one.
5. Right of withdrawal
As a consumer you have a statutory right of withdrawal of 14 days when buying a paid package. It exists vis-à-vis Digistore24 as your contractual partner; the withdrawal policy that Digistore24 provides during checkout and in the order confirmation governs. The model withdrawal form is provided there as well.
Please note: the right of withdrawal can expire early if you expressly request that performance begin before the withdrawal period ends and confirm that you thereby lose your right of withdrawal (Section 356(4) of the German Civil Code). That is exactly what happens if you start an event immediately after purchase. If you want to keep your right of withdrawal, wait before starting the event.
The free package creates no payment obligation, so a right of withdrawal is irrelevant there. You can delete your account yourself at any time.
6. Your duties as a host
You decide who is invited to your event, who takes photos and who may see the gallery. That makes you jointly responsible under data protection law for the processing of photos in your event. In particular, you undertake to:
- tell your guests before the celebration that photos are being taken and where the images go,
- obtain the necessary consent of the people shown – for children, from those with parental responsibility,
- share the event link only within the intended circle and not post it publicly,
- deal promptly with your guests’ deletion and access requests and involve us where needed,
- not use the gallery for commercial purposes, advertising or public publication.
7. Rules for photos and content
You may only upload photos that are your own or that you are lawfully entitled to use, and you must respect the personality rights of everyone shown. The following are not permitted in particular:
- covert, humiliating or degrading images,
- images from the most private sphere, for instance in changing rooms, bathrooms or toilets,
- intimate or sexualised depictions, without exception and all the more so of minors,
- content that infringes third-party rights, incites criminal offences or is hateful, insulting or otherwise unlawful,
- malware, automated bulk uploads and attempts to circumvent technical limits or access restrictions.
The event camera is not a storage or backup service and is not intended for content unrelated to the celebration.
8. Rights to photos
Copyright and personality rights remain with the rights holders. You grant us only the non-exclusive rights, limited to the storage period of the event, that we technically need in order to store, convert, resize and watermark the photos and to display them within the event and make them available for download. We acquire no rights beyond that.
We do not use photos from events for advertising, face recognition or AI model training, and we do not pass them on to third parties unless this is necessary to provide the service or we are legally obliged to.
9. Availability, retention and backups
We operate the service with customary care but do not owe any particular level of availability. Maintenance, faults at upstream providers, network outages and force majeure can temporarily limit reachability. The camera requires a current browser with camera access and, for uploads, an internet connection.
Sammelmomente is not an archive. Once the package period ends – 7 days on the free package, 90 days on the paid ones – the event and its media are blocked and then deleted. Download important images in good time. Photos still waiting on a guest’s device are not backed up with us and are lost if browser data is cleared. We do not owe a backup; keep your own copy of the images that matter to you.
10. Misuse, reports and blocking
Please report unlawful content or content breaching clause 7 to [email protected]. The event link, a description of the image and the reason for the complaint help. We look at every report and remove content as soon as we obtain knowledge of a specific infringement. We may block affected access and events, and in serious or repeated cases the account too.
Before a permanent block we hear you out where that is reasonable in the circumstances. We inform you about the removal of content and the reason for it as far as we can reach you. If you disagree with a measure, you can object within six months at the address above; we will then review the decision again.
11. Warranty
Statutory rights in respect of defects apply to paid packages. There is no defect where an impairment is caused by your hardware, your browser, your internet connection or by use contrary to these terms. Descriptions of the service are not guarantees; we assume a guarantee only where we expressly designate it as such in writing.
12. Liability
We are liable to you without limitation for intent and gross negligence, for fraudulent concealment of a defect, for injury to life, body or health, to the extent of any guarantee we have assumed and under the German Product Liability Act.
Where we slightly negligently breach a material contractual obligation, our liability is limited in amount to the foreseeable damage typical for this type of contract at the time it was concluded. Material contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely.
Otherwise our liability for slight negligence is excluded.
For damage arising from loss of data we are liable only up to the amount that would have been incurred for restoration had you backed up the data properly and regularly.
For use of the free package we are liable – as it is a gratuitous service – only for intent and gross negligence; liability for life, body and health and under the German Product Liability Act remains unaffected here too.
We are not responsible for content uploaded by hosts or guests; Sections 7 to 10 DDG apply. Nor are we liable for whether a host has obtained the consents required under clause 6, for a guest passing on an event link, or for downloaded copies being further distributed outside our system. We are not liable for the services of Digistore24 or for its payment processing.
The above limitations also apply to the personal liability of our legal representatives, employees and vicarious agents.
13. Indemnity
If your content or the way you use the service infringes third-party rights, you indemnify us against the resulting third-party claims to the extent you are responsible for the infringement. This includes the cost of reasonable legal defence. We will inform you of such claims without delay and coordinate with you before acknowledging or settling them.
14. Term, deletion and termination
The usage contract runs for an indefinite period. You may end it at any time without notice by deleting your account under “Account”; this deletes your events and photos. We may terminate the contract in text form giving 30 days’ notice; the right to terminate for good cause remains unaffected. An event already paid for and still running remains usable until its package period expires, unless we terminate for good cause for which you are responsible.
15. Changes to these terms
We may amend these terms where this is necessary because of a change in the law, in case law, for technical reasons or because the service has developed further, and where this does not unreasonably disadvantage you. We announce changes by email at least six weeks in advance and point out the change, the date it takes effect and your right to object. If you do not object before it takes effect, the changes are deemed accepted. If you object, we may terminate the contract as of that date; an event already paid for remains usable under the previous terms until its package period expires.
16. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected.
If you are a merchant, a legal entity under public law or a special fund under public law, Hamburg is the exclusive place of jurisdiction. For consumers the statutory places of jurisdiction apply.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG).
Should any provision be invalid, the remainder of the contract stays valid; the statutory rule takes the place of the invalid provision.
Our Privacy Policy applies in addition; for guests, so does the consent to the event camera. Last updated: September 2026.
